These Terms & Conditions (“Terms”) govern your use of this website and the plumbing services Tioga Plumbing provides across the Dallas–Fort Worth metroplex. By using the site or requesting service, you agree to them.

Informational only — not legal advice. This page describes the terms on which we do business. It is not legal advice, and nothing on this website is a substitute for an on-site diagnosis by a licensed plumber or for advice from your own attorney, insurer, or engineer.

1. General Information

1.1 These Terms are between you and Tioga Contractors LLC, doing business as Tioga Plumbing (“Tioga,” “we,” “us,” or “our”), a family-owned plumbing contractor based at 136 S Norwood Dr, Hurst, TX 76053, serving residential and commercial customers throughout the Dallas–Fort Worth metroplex. The Carter family has worked the plumbing trade in North Texas since 1953.

1.2 Plumbing work is performed under Texas Master Plumber license M-13661 (Jerry Carter), and we additionally hold licenses RME-U-1771420 and SCR-U-1771429. Our current license numbers are M-13661, RME-U-1771420, SCR-U-1771429.

1.3 These Terms apply to everyone who uses this website or engages our services — customers, visitors, prospective customers, and job applicants.

2. Acceptance of These Terms

2.1 By visiting this website, calling or texting us, submitting a form, booking online, or accepting plumbing service from us, you accept these Terms. If you do not agree with them, please do not use the website or request service.

2.2 If you sign a written proposal, work authorization, or service agreement with us, that signed document controls the work itself. These Terms fill in anything the signed document does not address. Where the two genuinely conflict about the scope, price, or warranty of a specific job, the signed document wins.

2.3 You confirm you are at least 18 years old and legally able to enter into this agreement, and that you either own the property where work is requested or are authorized by the owner to approve the work.

3. Our Services

3.1 We provide residential and commercial plumbing services, including 24/7 emergency plumbing, water heater and tankless water heater repair and installation, drain cleaning, slab leak repair, gas line and gas leak repair, leak detection, sewer and pipe repair and repiping, fixtures, garbage disposals, sump pumps, and water filtration and softening. The specific scope for your job is defined by your written quote, proposal, or invoice — not by this website.

3.2 All work is performed by trained, background-checked technicians under the supervision of a Texas Master Plumber, in accordance with the rules of the Texas State Board of Plumbing Examiners and applicable state and local plumbing codes. Where a permit is required, we obtain it and coordinate inspection.

3.3 We may decline or discontinue service for legitimate reasons, including unsafe site conditions, inaccessible work areas, suspected code or permit violations created by others, abusive conduct toward our team, an unpaid balance, or work that falls outside our licensed scope. Where we decline mid-visit, you owe nothing for the visit itself — only any additional diagnostic fee already disclosed and performed applies.

3.4 Arrival windows, response times, and same-day availability are good-faith targets that depend on dispatch load, weather, traffic, and emergency volume. They are not guarantees, and we are not liable for delays outside our reasonable control.

4. Estimates, Quotes & Diagnostics

4.1 Anything we tell you before a technician sees the work is a good-faith ballpark, not an offer, and not a binding contract. Prices quoted over the phone, by text, by email, or shown anywhere on this website are general information only. Plumbing problems routinely look different once the panel comes off or the slab is scanned — a “slow drain” can turn out to be a collapsed sewer line.

4.2 All pricing is subject to on-site inspection. A price becomes binding only when we put it in writing — on paper or on our technician’s tablet — and you approve or sign it. Until then, no contract for the work exists.

4.3 Written flat-rate quotes are valid for 30 days from issuance unless the quote states otherwise, and they cover only the scope described in them. After 30 days, material costs and availability may require a revised quote.

4.4 Service visits. We do not charge a fee for a technician to come out and look at the job — ever. If the job needs additional diagnostic work beyond a standard visit (for example, camera inspection of an inaccessible line), we will tell you about that fee in advance, before it applies, and you can decline it at no charge.

4.5 We don’t publish price ranges on this website. Every job gets its own written, flat-rate quote before work starts — see book now to schedule yours.

5. Scheduling, Access & Cancellation

5.1 When you book, we give you an arrival window and keep you posted if anything changes. Emergency calls take priority and can shift a non-emergency window; we will tell you when that happens.

5.2 You may cancel or reschedule at no charge with reasonable advance notice — a call or text the day before is plenty.

5.3 If nobody 18 or older is present when the technician arrives, or you cancel after the technician is en route, we may charge a missed-appointment fee disclosed in advance, and may require prepayment before scheduling future appointments.

6. Customer Responsibilities

6.1 You agree to:

  • have an adult (18+) present for the duration of the visit, or arrange authorized access in writing;
  • provide safe, clear access to the work area — including space around water heaters, cleanouts, crawl spaces, meters, and under-sink cabinets;
  • secure pets, and disclose known hazards such as gas odors, asbestos, lead, mold, standing sewage, or unpermitted prior work;
  • identify the location of private utilities, sprinkler lines, septic components, pools, and buried structures that a public locate service will not mark;
  • move or protect valuables, and tell us in advance about surfaces or finishes that require special care;
  • promptly report any concern about the work so we can address it while we are still on site or under warranty.

6.2 We are not responsible for damage arising from conditions you knew about and did not disclose, from unmarked private lines, or from pre-existing defects in the plumbing, structure, or finishes we had to access.

7. Pricing & Payment

7.1 We use upfront, flat-rate pricing. Before work begins, you receive a written quote for the job, and no work starts until you approve it. The price you approve is the price you pay for that approved scope, regardless of how long it takes us.

7.2 Change orders. If the scope changes once work is under way — concealed damage behind a wall, a corroded line the camera could not see, a code requirement triggered by the repair — we stop, explain the change, and get your approval in writing before continuing.

7.3 Deposits. Larger projects such as repipes, sewer replacements, tankless conversions, and commercial work may require a deposit before scheduling. The deposit amount and its refund terms will be stated on your written proposal.

7.4 Payment is due on completion unless your written agreement says otherwise. Payments and any financing application are processed by third-party providers; we do not collect or store card numbers on this website.

7.5 Financing. Financing is offered through independent third-party lenders, including Service Finance Company, LLC and Synchrony. Approval, rates, terms, promotional periods, and servicing are set entirely by the lender and are subject to credit approval. Tioga is not the lender, does not make credit decisions, and does not guarantee any financing outcome.

7.6 Late payment. Past-due balances may accrue a service charge of 1.5% per month (or the maximum rate allowed by Texas law, whichever is lower), plus our reasonable costs of collection, including attorneys’ fees where permitted. Texas law also gives contractors lien rights on unpaid work. We treat a lien as a last resort, but we reserve every right available to us under Texas Property Code Chapter 53.

7.7 Prices, promotions, and discounts published on this website may change without notice and cannot be combined unless we say so in writing. Discount programs require eligible verification at the time of service.

8. Gator Family Membership

8.1 The Gator Family Membership is an annual maintenance plan billed at $149 per year. Current benefits are described on the membership page and are the controlling description of what the plan includes.

8.2 The membership is a maintenance and priority-service plan. It is not insurance, not a home warranty, and not a service contract covering the cost of repairs or replacement parts. Member discounts apply to the work described in your plan terms and do not apply retroactively to completed jobs.

8.3 Membership benefits are available while the membership is paid and current, and priority scheduling is subject to dispatch availability. We may change plan benefits or pricing on renewal with notice; changes do not affect the term you already paid for.

9. Warranties

9.1 We stand behind our labor. The workmanship warranty for your job is stated on your invoice or service agreement, with a minimum of one year on repairs and longer coverage on many installations. The full breakdown of coverage tiers lives on our warranty page, which is incorporated into these Terms by reference. Where the warranty page and your written invoice differ for a specific job, your invoice controls.

9.2 Manufacturer warranties. Equipment and fixtures — water heaters, tankless units, disposals, faucets, pumps, and similar — are covered by their manufacturers’ own warranties, which we pass through to you. Those claims are subject to the manufacturer’s terms, registration requirements, and decisions. We will help you file a claim, but we are not the warrantor of another company’s product.

9.3 Our workmanship warranty does not cover:

  • pre-existing conditions — problems that existed before our work, or in parts of the system we did not work on;
  • acts of God and external events — freezing, flooding, foundation movement, storms, tree roots, power surges, and municipal supply issues;
  • third-party or DIY work — damage caused by anyone else who works on the system after us, including your own modifications;
  • misuse or neglect — flushing inappropriate items, ignoring a known leak, running a disposal dry, or skipping stated maintenance;
  • customer-supplied parts — we warrant our installation labor, not a fixture you purchased elsewhere.

9.4 To make a warranty claim, call us at 817-484-5356 and reference the invoice from the original job. Warranty calls go straight to dispatch.

10. The $25,000 Program Guarantee

10.1 Tioga Plumbing is a vetted member of The Good Contractors List. The $25,000 guarantee you may see advertised is provided by that third-party program, under that program’s own terms — it is not an in-house warranty issued by Tioga Plumbing, and we do not administer it.

10.2 Eligibility, claim procedures, coverage limits, exclusions, and remedies are set and decided by The Good Contractors List. Review them at The Good Contractors List. Nothing in these Terms expands, modifies, guarantees, or replaces the program’s terms.

10.3 The program guarantee operates independently of and in addition to our own workmanship warranty in Section 9. Our other commitments are described on the guarantees page. Nothing on that page or this one creates a cash guarantee payable by Tioga.

11. Calls & Text Messages (TCPA Consent)

11.1 Your consent

When you check the consent box on one of our forms, text us first, or otherwise opt in, you expressly consent to receive calls and text messages from Tioga Plumbing at the number you provided — including calls or texts placed with automated technology — about your service request: scheduling confirmations, appointment reminders, technician-arrival updates, estimates, invoices, and follow-ups.

11.2 Message frequency

Message frequency varies with your service activity and the nature of your request.

11.3 Message and data rates

Standard message and data rates may apply, depending on your carrier and plan.

11.4 How to opt out

Reply STOP to any message to cancel. You will receive one confirmation message and then no further texts unless you opt in again.

11.6 Consent is never required

Consent to receive calls or texts is not a condition of purchasing any service. You can always reach us by phone instead. Calls to and from our office may be recorded — see our Privacy Policy for how we handle your number, your opt-in status, and call recordings.

12. Use of This Website

12.1 We grant you a limited, revocable, non-exclusive, non-transferable license to view this website and to temporarily download one copy of its materials for personal, non-commercial use. This is a license, not a transfer of title, and it terminates automatically if you breach these Terms.

12.2 Under this license you may not:

  • modify, copy, or create derivative works from the materials;
  • use them for any commercial purpose or public display;
  • remove copyright, trademark, or other proprietary notices;
  • mirror, frame, or republish the materials on another server.

12.3 Website content is general information, not professional advice. Guides, cost ranges, diagnostic tools, blog posts, and Learning Center articles describe typical DFW conditions. They are not a diagnosis of your plumbing system, not an engineering or code opinion, and not legal advice. Only an on-site inspection by a licensed plumber can tell you what your system actually needs. Never use this site to decide how to respond to a gas odor, a sewage backup, or an active flood — shut off the supply if it is safe to do so, leave the building if you smell gas, and call us or 911.

12.4 We work to keep the site accurate but do not guarantee it is error-free, complete, or current, and we may change or remove content at any time without notice.

13. Intellectual Property

13.1 Everything on this website — text, photographs, illustrations, graphics, page design and layout, the Tioga name and logo, and the gator mascot artwork — belongs to Tioga Plumbing or its licensors and is protected by United States copyright and trademark law.

13.2 You may not copy, scrape, index for resale, republish, or reuse any of it for commercial purposes without our prior written permission. Trademarks and product names of manufacturers and partners referenced on this site belong to their respective owners and are used for identification only.

14. Content You Submit

14.1 If you send us photos of your plumbing problem, reviews, testimonials, job applications, or other content, you keep ownership of it. You grant Tioga Plumbing a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content to provide and improve our services and — for reviews and testimonials — to market our business.

14.2 You represent that anything you submit is yours to share, is accurate, and does not violate anyone else’s rights or privacy. Do not send us anyone’s sensitive personal information.

14.3 We may decline, edit for length, or remove submitted content at our discretion, and we are under no obligation to publish anything you send.

15. Prohibited Uses

15.1 You agree not to:

  • submit false, misleading, or fraudulent service requests, applications, or reviews;
  • probe, scan, or attempt to breach the website’s security, or interfere with its operation or availability;
  • use bots, scrapers, or automated tools to harvest content, images, pricing, or contact information from the site;
  • impersonate Tioga Plumbing, our technicians, or any other person or business;
  • use the website in any way that violates federal, Texas, or local law.

16. Third-Party Links

16.1 This website links to outside resources we believe are useful — financing partners, The Good Contractors List, our Google Business Profile, the Better Business Bureau, equipment manufacturers, and city utility or permit portals. We have not reviewed all the material on those sites and are not responsible for their content, accuracy, availability, or practices. A link is not an endorsement, and your use of any linked site is at your own risk and subject to that site’s own terms.

17. Privacy

17.1 Our collection and use of personal information — including call recording, call tracking, cookies and analytics, and your Texas privacy rights — is governed by our Privacy Policy, which is incorporated into these Terms by reference.

17.2 Your choices about cookies, analytics, advertising measurement, text messages, and your California “Do Not Sell or Share My Personal Information” rights are collected in one place at Privacy Policy § 12, Your Privacy Choices. Our cookie notice offers Accept and Decline, and we honor Global Privacy Control browser signals automatically.

18. Disclaimer of Warranties

18.1 THIS WEBSITE AND ITS MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TIOGA PLUMBING DISCLAIMS ALL WARRANTIES ABOUT THE WEBSITE, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

18.2 This section disclaims warranties about the website only. The workmanship warranty in Section 9 and any warranty stated on your signed service agreement remain fully in force. Nothing here disclaims a warranty that cannot be disclaimed under Texas law.

19. Limitation of Liability

19.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIOGA PLUMBING’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THIS WEBSITE, OR OUR SERVICES IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM.

19.2 IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF USE, DIMINUTION IN PROPERTY VALUE, OR THE COST OF SUBSTITUTE SERVICES — EVEN IF WE WERE ADVISED SUCH DAMAGES WERE POSSIBLE.

19.3 Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of Sections 18 and 19 may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by our negligence, or the remedies stated in your signed service agreement.

20. Indemnification

20.1 You agree to defend, indemnify, and hold harmless Tioga Plumbing, its owners, officers, employees, and technicians from any third-party claims, damages, losses, and reasonable attorneys’ fees arising out of your breach of these Terms, your misuse of the website, content you submit, hazards or conditions you failed to disclose, or your violation of any law or the rights of a third party.

20.2 This obligation does not apply to claims caused by our own negligence or willful misconduct.

21. Dispute Resolution & Arbitration

Please read this section carefully. It affects your rights, including your right to file a lawsuit in court and to have a jury trial.

21.1 Talk to us first

Most problems are a phone call away from being fixed. Before starting any formal proceeding, you agree to contact us at 817-484-5356 or [email protected] and give us 30 days to resolve the issue.

21.2 Binding individual arbitration

Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, this website, or our services — whether based in contract, tort, statute, or any other theory — will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect when the claim is filed. The arbitration will take place in Tarrant County, Texas, unless the AAA rules or the arbitrator provide otherwise for your convenience. The arbitrator’s award is final and binding and may be entered as a judgment in any court with jurisdiction. AAA rules and fee schedules are at adr.org.

21.3 Class action waiver

ALL DISPUTES MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the rest of this Section 21 still applies.

21.4 Small-claims carve-out

Either you or we may instead bring an individual claim in small-claims court — in Texas, the Justice Court for the precinct where the work was performed or where you reside — as long as the claim qualifies and stays in that court. Either party may also seek injunctive relief in court to protect intellectual property or stop unauthorized use of the website.

21.5 Your 30-day right to opt out

You may reject this arbitration agreement and class action waiver by sending written notice within 30 days of the date you first accept these Terms (for service customers, the date of your first appointment). Send it to [email protected] or by mail to Tioga Plumbing, 136 S Norwood Dr, Hurst, TX 76053, including your name, address, phone number, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms or the service you receive from us.

22. Governing Law & Venue

22.1 These Terms and any dispute arising from them are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

22.2 For any matter properly brought in court — small-claims cases, an action to enforce an arbitration award, injunctive relief, or claims where the arbitration agreement does not apply — you and we agree the exclusive venue is the state courts located in Tarrant County, Texas, or the United States District Court whose district includes Tarrant County, and both parties consent to personal jurisdiction there.

23. General Provisions

23.1 Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in full force.

23.2 No waiver. Our failure to enforce any provision is not a waiver of it or of any other provision.

23.3 Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of the business.

23.4 Force majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, freezes, floods, utility failures, supply-chain shortages, labor disputes, and government action.

23.5 Entire agreement. These Terms, together with our Privacy Policy and any signed proposal, work authorization, or service agreement, are the entire agreement between you and Tioga Plumbing regarding this website and our services, and supersede any prior understanding.

24. Changes to These Terms

24.1 We may update these Terms from time to time. The “Last updated” date at the top always reflects the current version, and material changes will be posted on this page.

24.2 Continued use of the website or our services after changes are posted constitutes acceptance of the updated Terms. Changes do not apply retroactively to work already performed under an earlier version, and the terms in effect when you signed a proposal continue to govern that job.
